who were texting. that is a 41% increase from the previous year. cops are really worried about that fact because it takes drivers' eyes off the road. they say they try to be good. >> if you have an emergency call you have to answer it. they might pull you over. they are doing their job. >> it makes sense. people are more aware it's dangerous, it's a dangerous situation to put other people in >> reporter: in 2011 more than 3,000 people were killed in crashes blamed on distracted driving. a new study shows that 69% of u.s. drivers say they talk on cellphones and about one in three read or send texts or

emails while driving. that habit could have deadly consequences. >> eric: new details are still coming to lighted in a man's rampage at crowded walmart store in the south bay. they tell abc news the driver hit two cars before driving through the front of the store. front of the store is boarded upright now after the rampage but this is right after the incident. some of this video posted on youtube. after the driver crashed into a storefront he got out and swung a club at customers. four people were hurt and one seriously. they have not released the name of driver but the car is registered to a hamid zayid. >> they are investigating three separate fatal shootings in the span of three hours. it happened at 8:00 last night

at 70th avenue. follows two other shooting international boulevard, one-half 4:00 p.m. and another about 10:00 yesterday morning. they examined this car with a shot out window and looked for other clues. victim died after being rushed to the hospital. no arrests have been made. >> eric: teammates of a college athlete killed near his home in san francisco are planning a public memorial for him. 19-year-old jacob valdiviezo was shot and killed saturday morning. investigators believe he they mistook him him for a gang member. >> he was star athlete and honor student at archbishop reardon high school. his college teammates discussed and reflect on the logs. now, they are planning a memorial for him on campus as police continue to search for

his killer. tomorrow marks the first anniversary 69 shooting massacre that took the lives of 7 students. former nursing student planned the shooting after getting angry with school officials. they have ruled that he is incompetent to stand oil. oikos will hold two m78s and one will be in eldorado hills on april 14 zblth the music returns this week as the san francisco symphony reaches an contract agreement with musicians. the musicians must still ratify their contract which would end their strike. detail have not been made public but the union was seeking a pay raise and more transparency in symphony accounting. it cancelled several perform answers including the carnegie hall. drivers may face detours.

detroit. it's 5:13. you are looking live at detroit metro airport. there has been a suspicious device found during a scan of luggage. so the police have evacuated the north terminal of detroit metro. they don't know what the item is, but the bad thing about it a lot of people were evacuated were spring break travelers wearing shorts and t-shirts making a cold walk in detroit from the north terminal to the smith terminal. we'll let you know more about the story as it develops. no word on airport delays, but once again a suspicious package found there at the airport. >> just shy of 5:14. north korea is escalating verbal tension by declaring a state of war with south korea. united states is supporting its ally with a show of air power. joining us live from washington, good morning devin. >> reporter: good morning.

the standoff with north korea remains a war of words but officials at washington say the u.s. military is respond to an attack. >> the warnings out of north korea this morning are increasingly ominous. declaring a state of war with south korea as the nation's leader today gathered the supreme people's assembly. they declared the nuclear weapons the nation's life and not to trade them for billions of dollars. the u.s. is taking the threat seriously deployed two stealth fighter jets, a routine military drill meant as a show of force. >> we have a range of options to counter their provocations and threats. we hope not to put plans into effect. >> last month, u.s. sent two b-2 bombers to south korea and back. the u.s. and north korea are not at war. >> we believe this is part of

that is incidents what is going on right now. you can see zoom down near hayward right on 238, you can see on vanderbilt street right there and seeing some of the better radar returns, heading over to wickes boulevard, farallones drive. some of the better radar returns. when we broaden out the picture it's mainly from the bay bridge but finding the radar returns, as was the case yesterday, it's moving from south to north. if you live north of this area, we do have rain on the way and reduced visibility. down to three miles in hayward and mile and a quarter in half moon bay. we're going to get most widespread rain with scattered showers and scattered sunshine this afternoon and temperatures about where they were yesterday. good morning. >> good morning, mike. we do have few extra cars out on

so starting today, statewide they will be cracking down on drivers that tha will be texting or talking while driving. last year they wrote 400,000 tickets for people using a handheld device and 21,000 tickets texting while driving. that is 41% increase for texting. cops are concerned about that because it takes drivers' eyes off the road. we are talking to drivers this morning. here is what this some of them had to say. >> it's a common thing. they are driving faster. >> what do you think of that? >> it's terrible. it's worse than drunk driving i think. behind folks they are swerving. >> sometimes you know you have to. if you have an emergency call or something you got to answer. they still pull over.

from the 14 mission bus. >> san francisco list have arrested two people and detained three others for shooting a man at a park last night. it at on campbell avenue. 24-year-old victim went to the hospital emergency room with a leg wound. he was last reported in surgery with life-threatening injuries. they arrested two suspects blocks from the shooting scene. >> eric: we are learning new details about a man's rampage at a san jose walmart store over the weekend. witnesses tell "abc 7 news" he hit two cars and tried to run over people in the parking lot before plowing through the front of the store. here is a live picture from that store on story road in san jose. you can see the plywood is up covering the glass and steel doors that were smashed in yesterday. this video was shot right after the incident. witnesses say after the driver crashed into a beer display, he got out and begin swinging a club at customers. four people were hurt.

list have not yet released the driver's name but the car is registered to a hamid syyid. >> in vallejo residents have to thank firefighters after saving their homes after a fire on a tour bus. look at that. the tour bus fully engulfed in flames. luckily there were no passengers on board and the driver made it you out safely but the flames spread quickly to several trees that sit between the interstate and apartment building. firefighters worked quickly to flames to reach the apartments. >> eric: jury deliberations are set to begin this morning in a federal wrongful death case filed by the widow of a barbershop owner that was killed by oakland police. derek jones was shot dead by two

oakland police officers responding to a domestic disturbance call at his barbershop in november of 2010. they say jones ran when the officers tried to question him and they fired six rounds believing he was in the process of pulling out a gun. a search of the scene failed to turn up any firearms. the widow is seeking unspecified damages. newest members of the oakland police department will hit the streets today, 38 newly sworn in officers will patrol with their field training officers today. they graduated just last week from oak's first police academy in nearly five years. the department now has a total of 649 officers. still well below the 837 it had in 2008. a new police academy started with 51 recruits. >> eric: senators are trying to reach an agreement on immigration reform plan. they agreed on a provision that will allow thousands of workers

with limited skills to enter the u.s.a. group of eight senators from both parties they have agreed on a plan that calls for giving 11 million undocumented immigrants a path to citizenship. some republican senators more details need to be worked out. a rally l take place in oakland calling for full citizenship for all residents at open borders. march will follow into downtown oakland. new from overnight, fast moving storm packing thunder and lightning hit parts of the bay area. in solano county, here is a look at the lightning that struck. in stockton, lightning and heavy rain was also captured on video. you can hear the rain coming down. if you listen you can hear thunder, as well. the thorngs of since expired. >> i wonder what we do without those youtube videos in those

they rejected a plea deal from the defense last week because his attorney would not release results of psychiatric tests. 25-year-old is accused of opening fire in a packed theater last july killing 12 people and wounding 70 more. even though capital punishment is legal in colorado, the state hasn't executed anyone since 1977. >> it could soon cost you lot more to park in one city. berkeley will consider raising the price of a street parking permit by 60% to $55 a year. they have been cracking down on parking violators, from citing people that use disabled placards to booting the cars of delinquent violators. cost of these programs runs higher% the money they bring in. the permit hike will discussed at tomorrow night's council meeting. >> possibly nicer weather but we have to get through some rain

>> eric: good morning, a new report is revealing a dramatic rise in the number of children diagnosed with adhd. nearly 20% of high school aged boys and 11% of children overall have received a diagnosis of ad hfd according to cdc. estimated 6.4 million children have received an adhd diagnosis at some point in their lives. some critics say the rise could be a sign that the adhd diagnosis and medication used to treat it are being overused.

there is power in numbers when it comes to trying to lose weight. researchers at the university of pennsylvania studied three groups of people trying to shed pounds. one group had each participant receiving hundred dollars for every month they lost weight. another group had an incentive, if they all lost weight each month, they shared 5 holdup. final group was set to lose weight alone and not get paid. after six months, group incentive participants, those who split the $500 if they lost the most weight, they did lose the most, between 7-10 pounds. i guess you have that kind of group atmosphere where you feel responsible for losing weight to other people, that will get you going. >> eric: its green activity, money, the way they did it.
